Britney Spears is facing a misdemeanor DUI charge in California, adding a legal deadline to a stretch that has already included an arrest, a voluntary rehab stay and renewed scrutiny around her wellbeing.
The Ventura County District Attorney’s Office said on Thursday that the 44-year-old singer has been charged with driving under the combined influence of alcohol and drugs. Her case is scheduled for court on May 4, though prosecutors said she may not need to appear in person because the charge is a misdemeanor, meaning her attorney can appear on her behalf.
What prosecutors say happens next
According to the District Attorney’s Office, Spears could receive 12 months of probation if she pleads guilty to reckless driving. Under that outcome, she would be required to complete a driving under the influence class and pay state-mandated fines and fees.
Prosecutors said that possible handling reflects several factors:
- Spears has no prior DUI history.
- No crash or injury was reported in the arrest.
- Her blood alcohol level was described as low.
DUI, short for driving under the influence, can cover alcohol, drugs or a combination of both depending on the charge. In this case, the allegation involves both alcohol and drugs.
The March arrest
Spears was arrested on March 5 in California after police said she was seen driving “erratically.”
Officers said she “showed signs of impairment and submitted to a series of field sobriety tests” after being pulled over. Police said Spears was alone in a black BMW 430i when she was arrested on suspicion of “driving under the influence of a combination of drugs and alcohol.”
She was taken to Ventura County Main Jail, northwest of Los Angeles.
At the time, a representative described the “unfortunate incident” as “completely inexcusable” and said it would ideally be “the first step in long overdue change that needs to occur in Britney’s life.”
The representative added: “Her boys are going to be spending time with her.
“Her loved ones are going to come up with an overdue needed plan to set her up for success for wellbeing.”
Rehab and reported recovery
Spears voluntarily checked into rehab in early April following the incident and reportedly left on Wednesday night.
Page Six, the New York Post column, quoted a source saying Spears is “doing really well” after treatment. The source said: “She’s healthy and happy and feeling very positive and excited to start afresh. Rehab was a great opportunity for her to ground herself.
“She’s looking forward to a bright future.”
A second source told the publication that Spears is “continuing counselling remotely.” She has since been pictured in the passenger seat of a car in Calabasas, California, in what was reported as her first public sighting after leaving rehab.
Representatives for Spears have been contacted for comment.
A high-profile career, and a complicated new chapter
The charge arrives during another major business shift for Spears. In February, she sold part of the rights to her back catalogue to music publisher Primary Wave for an undisclosed fee.
That deal followed the end of Spears’ 13-year conservatorship in 2021. The legal arrangement had controlled major decisions around her career and finances, and its termination marked one of the most closely watched celebrity legal battles of the last decade.
Spears’ most recent releases include her 2022 collaboration with Sir Elton John and the 2023 track Mind Your Business with Black Eyed Peas member Will.i.am.
Across her career, the Mississippi-born singer has scored six UK number one singles and eight UK top 10 albums. She has also worked with artists including Madonna, Rihanna, Iggy Azalea and Backstreet Boys.
This is not Spears’ first driving-related legal issue. In 2007, she avoided a criminal hit-and-run trial by paying damages after photographers captured her steering into another vehicle while trying to park in a California car park, then walking away after checking the damage to her own car.
For now, the next fixed date is May 4 in Ventura County court. The pop catalogue may be historic, but the legal calendar is very current.
