The Halle Berry custody battle has intensified, with the actor accusing former husband Olivier Martinez of influencing their 13-year-old son, Maceo, to behave in an “angry and combative” manner toward her. The claims appear in new court documents obtained by People on Monday.

Berry has asked the court to reinstate the former couple’s 50/50 custody arrangement. Martinez currently has primary custody and obtained a temporary restraining order after alleging that Berry choked their son during an argument. Through her lawyer, Berry has denied those allegations, calling his filing “entirely meritless and deliberately misleading.”

Why Berry wants equal custody restored

In her filing, Berry claims Martinez has repeatedly tried to align Maceo with him and against her across different parts of the teenager’s life. She alleges that this conduct has damaged her relationship with their son and weakened her authority as a parent.

“When Maceo would come home from his custodial time with Olivier, he would be angry and combative,” Berry states in the documents.

She also claims Maceo began repeating details from private disagreements between the former couple and adopting his father’s position. According to Berry, Martinez’s alleged conduct has affected Maceo personally as well as academically.

“[Martinez’s] refusal to allow early interventions have caused Maceo to fall further behind in school, caused Maceo’s acting out behaviors to worsen, and caused further damage to Maceo’s and [Berry’s] relationship,” the filing states.

Berry further alleges that Martinez has refused to accept her relationship with her fiancé, musician Van Hunt. She says he has prevented Maceo from attending family therapy with Berry and Hunt, which she argues would help them build a healthy blended family. Apparently even professionally supervised communication has become another item requiring judicial attention.

What Berry is asking the court to order

Along with restoring equal custody, Berry wants the court to require Martinez to attend therapy sessions that were previously ordered. Martinez, a French actor, filed a response asking the court to reject her request, according to People.

The latest filing arrived shortly after Berry and Hunt were seen spending time with Maceo in Los Angeles. Photographs obtained by Page Six showed the three visiting Sky Zone on Sunday with several of the teenager’s friends.

That public outing followed far more serious claims in Martinez’s court papers. He alleged that an argument on September 26 began while Maceo was playing a virtual reality game. According to Martinez, Berry jumped on the teenager, placed her hands around his neck and choked him.

Martinez also alleged that the incident formed part of a wider pattern rather than an isolated confrontation. His filing claimed that during the previous year and a half, Berry had wrestled Maceo to the ground and forced him to “tap out.” He included private text messages that he said showed Maceo asking his father to collect him after the alleged choking incident.

No court finding confirming those accusations was cited in the report. Both sides are presenting sharply conflicting accounts, leaving the family court with the unenviable job of sorting through them.

How Berry has answered Martinez’s allegations

Berry’s attorney, Marina Beck, rejected Martinez’s account and argued that the available record instead shows he interfered with support recommended for their son.

“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo,” Beck said in a statement to Page Six.

She added that Martinez had already faced legal sanctions over that alleged misconduct. Berry’s new filing similarly focuses on access to therapy, educational intervention and rebuilding her relationship with Maceo.

The legal dispute extends an already lengthy separation. Halle Berry and Olivier Martinez, both 60, met while working on the film Dark Tide in July 2010. They married in July 2013, separated in October 2015 and spent eight years finalizing their divorce.

Their marriage lasted about two years. The legal aftermath has proved considerably more durable.
