Elizabeth Holmes’ prison release conditions will prohibit the Theranos founder from contacting the 14 investor victims in her fraud case unless a probation officer specifically instructs her to do so, according to court documents obtained by TMZ.
The restrictions form part of Holmes’ supervised release after federal custody. She and former Theranos executive Ramesh “Sunny” Balwani were ordered to pay more than $452 million in restitution to victims of the blood-testing company’s fraud.
Holmes must make payments to the investors and companies that lost money, including:
- $40 million owed to Walgreens
- More than $14 million owed to Safeway
- Additional restitution to the other victims named in the case
The order leaves little room for an awkward reunion tour. Unless probation officials approve contact, Holmes must stay away from the people she was convicted of deceiving.
What other restrictions will Holmes face?
Probation officers will receive broad access to Holmes’ finances. She must provide financial records, including tax returns, and permit credit checks intended to monitor her money and restitution payments.
The court documents also require Holmes to:
- Participate in a mental health treatment programme
- Provide a DNA sample
- Submit to searches of her home, workplace, vehicle or other property
- Follow any additional financial monitoring ordered by probation officials
Such conditions give federal authorities continued oversight after imprisonment. In practical terms, Holmes’ finances and conduct will remain subject to considerably more scrutiny than they were while Theranos was attracting major investors with claims about revolutionary blood-testing technology.
Federal prosecutors proved that Holmes used false and misleading claims to persuade investors to put money into Theranos. The company said its technology could run numerous tests from a small amount of blood, but its devices did not perform as promised.
When will Elizabeth Holmes leave prison?
Holmes has been held at Federal Prison Camp Bryan in Texas since May 2023. The Federal Bureau of Prisons lists her official release date as February 22, 2030.
Before then, she is expected to move to the Austin Transitional Center, a halfway house in Del Valle near Austin. ABC News reporter Rebecca Jarvis reported that victims received advance notice of a planned transfer date of August 23, 2027.
That placement means Holmes could spend several years at the transitional facility before completing her sentence. A halfway house generally allows more access to work and community activities than prison, but residents remain under federal custody and must follow strict rules.
Why was Holmes sent to federal prison?
A jury found Holmes guilty in January 2022 of three counts of wire fraud and one count of conspiracy to commit wire fraud against Theranos investors. She was acquitted on four other investor-related charges, while jurors failed to reach verdicts on three counts involving patients.
In November 2022, a federal judge sentenced her to more than 11 years in prison. She began serving that sentence the following May. A judge later reduced her punishment by one year in March, bringing the projected end of her custody closer while leaving the restitution order and post-release supervision intact.
Holmes founded Theranos in 2003 and built it into a company once valued at $9 billion. Its collapse followed reporting and regulatory investigations that exposed serious problems with its technology, laboratory practices and public claims. The criminal case eventually turned the former Silicon Valley celebrity into one of the technology sector’s most prominent convicted fraudsters.
